COMMON QUESTIONS
Frequently Asked Questions About Privacy & DPDP
Essential guidance regarding Indian data protection law, privacy policies, and fiduciary duties.
Yes. If your business operates a website, mobile application, or digital portal that collects personal data (such as names, phone numbers, email addresses, or transaction data) from individuals in India, you are classified as a Data Fiduciary under the DPDP Act, 2023 and the IT (Intermediary Guidelines) Rules, requiring clear notice specifying the personal data collected and the purpose of processing.
The Digital Personal Data Protection Act, 2023 empowers the Data Protection Board of India (DPBI) to adjudicate non-compliance and impose significant financial penalties, reaching up to ₹250 Crores for failure to take reasonable security safeguards to prevent personal data breaches, and up to ₹200 Crores for non-fulfillment of obligations concerning children's data or failure to notify a personal data breach.
A Data Fiduciary is the entity that determines the purpose and means of processing personal data (e.g., your company collecting customer information). A Data Processor is an external entity that processes data strictly on behalf of the fiduciary (e.g., a cloud hosting vendor, SMS gateway, or outsourced payroll software). The primary legal responsibility to the user remains with the Data Fiduciary.
Under Section 16 of the DPDP Act, 2023, personal data can generally be transferred outside India for processing, except to countries or territories specifically restricted or blacklisted by the Central Government via official notifications. However, organizations in specific sectors (such as banking and payments under RBI directives) must also adhere to strict domestic data localization mandates.
Under Section 9 of the DPDP Act, processing data of a child (an individual below 18 years of age) requires verifiable consent from the parent or lawful guardian. Additionally, Data Fiduciaries are strictly prohibited from undertaking tracking, behavioral monitoring, or targeted advertising directed at children, or processing data that could cause detrimental effects on their well-being.
